警察能否使用武器进行个人防卫目前无法律规定,所以警察个人遇到不法侵害时只能实行普通公民的正当防卫。警察非工作时间遇到暴力袭警危及生命安全时使用武器制止,其性质应属于警察使用武器进行职务防卫。警察被迫执行违法指令并使用武器防卫是与行使职权有关联的行为,亦属警察职务防卫。应及时完善警察使用武器进行个人防卫的立法,以保障警察的合法权益。
