小产权房在当今中国的处境十分尴尬,其在法律上一直都不被认可。现实中大量存在小产权房带来了诸多问题,小产权房的问题实质上是以土地为主的利益分配。对此,可以有诸多探讨。各方面更应与时俱进,敢于破除惯性思维,科学地进行分析,科学把握小产权房的原因及其困境,建立起农村集体建设用地使用权的流转制度。政府务必要转变发展方式,结合地方自身实际,由“土地财政”向其他发展方式转变。
Small property room in today’s situation in China is very embarrassing, it has not been legally recognized. In fact, a large number of small property ownership room has brought many problems, the problem of small property room is essentially the distribution of land-based interests. In this regard, there can be a lot of discussion. All aspects should be advancing with the times, dare to break the inertia of thinking, scientific analysis, scientifically grasp the reasons for small property room and its predicament, and establish a transfer system of rural collective construction land use rights. The government must change its mode of development and, in the light of the local conditions, change from “land finance” to other modes of development.
