我国至今仍然没有颁布一部关于集体建设用地的正规法律,仅仅只是在基本法《宪法》以及民事基本法《物权法》等法律中涉及集体建设用地流转,在法律支持方面还有所欠缺。对此,本文提出建立健全集体土地流转管理的相关制度、进一步完善集体建设用地流转的产权制度、修改限制集体建设用地流转的法律法规及建立起以广大群众为基础的监督制度,以进一步完善农村集体建设用地流转的法律制度。
China still has not promulgated a formal law on collectively-owned land for construction. It only involves the circulation of land for collective construction in laws such as the Constitution of the Basic Law and the Real Right Law of the Civil Basic Law, and there is a lack of legal support. In this regard, this paper proposes to establish and improve the system of collective land transfer management, further improve the system of property rights for collective construction land circulation, modify the laws and regulations that limit the circulation of collective construction land and establish a supervision system based on the masses to further improve the rural Collective construction land circulation of the legal system.
