伴随现代企业制度改革进程,上海市产权制度改革也取得初步成效。然而,由于产权法律法规跟不上产权制度改革的需要,使之各类产权的界定不准,导致产权交易难和产权市场化程度不高,产权改革的深化遭遇产权法制薄弱的“瓶颈”。产权制度改革最关键的是需要相应的法律支持。因此,一方面,建议全国人大或国务院修改完善有关法律和行政法规;另一方面,加快上海市地方产权法制建设。
With the reform of the modern enterprise system, the reform of the property system in Shanghai also achieved initial success. However, since the laws and regulations of property rights can not keep up with the reform of property rights system, the definition of property rights is not allowed, resulting in the difficulty of property rights trading and the low marketization of property rights. The deepening of property rights reform suffers from a weak “bottleneck” of property rights law. The key to the reform of the property right system is the need for appropriate legal support. Therefore, on the one hand, it is suggested that the NPC or the State Council revise and improve relevant laws and administrative regulations; on the other hand, we should speed up the construction of local property rights in Shanghai.
