物权法关于浮动抵押的规定,为商业银行开展动产抵押贷款提供了法律支持。动产抵押克服了动产质押要求转移占有的缺陷,以及传统抵押仅限于不动产的束缚,也为多动产资源少不动产资源的中小企业另辟了新的融资渠道。通过效仿银行的征信系统,建立统一的动产抵押登记电子网络系统,引进适当的私力救济以及直接申请法院强制执行等措施来进一步完善和推动贷款融资中动产抵押制度,对更好地满足市场资金需求,实现银企互动,促进经济发展具有重要意义。
The provisions of the Property Law on floating mortgages provide legal support for commercial banks to carry out movable property mortgage loans. The movable property mortgage overcomes the defects of transfer of the movable property pledge requirements, and the traditional mortgage is limited to the bondage of real estate. It also opens up new financing channels for small and medium-sized enterprises (SMEs) with less resources in real estate.
