强制消费是旅游市场中发生率极高的问题。2013年《中华人民共和国旅游法》的出台使强制消费现象得以缓解,但其缺陷也是显而易见的。本文从旅游中的强制消费的概念入手,并站在旅游经营者,导游以及旅游者角度分析强制消费屡禁不止的原因。有针对性的对现行法律中关于规制旅游强制消费的内容进行分析。旨找出相关法律规制的不足,并提出完善的建议。
Forced consumption is a very high rate in the tourism market. The introduction of the Travel Law of the People’s Republic of China in 2013 made the phenomenon of forced consumption eased, but its flaws are also obvious. This article starts from the conception of compulsory consumption in tourism, and analyzes the reason why the compulsive consumption is forbidden repeatedly from the perspectives of tour operators, tour guides and tourists. Targeted analysis of the current law governing the compulsory consumption of tourism content. To find out the shortcomings of the relevant laws and regulations, and put forward sound suggestions.
