航空侵权法的研究与适用在我国和世界范围内都比较薄弱,其发展急需方法论的指导。一般理论在应用领域的具体与明确属于具象性研究策略。为避免在应用领域的具体环节和事项上适用一般理论可能产生的不可欲后果,而提出例外方案,或者依照一般理论对只有该应用领域中出现的具体问题进行专门的分析得出解决方案,属于特别性策略。航空侵权的归责原则、航空配餐侵权问题、空管机构的侵权责任、攀机案件中的侵权责任等方面的研究都属于具象性研究策略的体现。而航空管理规则对飞行员的休息时长和连续工作时长的要求、航空旅客被拒载(尤其黑名单、超售)情形的精神损害问题的分析都属于特别性研究策略的体现。两种不同的研究策略本身具有一定程度的灵活相通性。
