实践中,保险代理人为获取更大利益,往往在销售保险时向客户提供旅游服务或赠送实物以示回馈。这种回馈并不在投保人与保险公司签订的保险合同中,亦非双方的委托项目。但上述法律关系,无论是保险公司还是保险代理人在保险产品销售过程中均未向客户披露。目前保险代理人普遍存在自称是某某保险公司的现象,其所传递的信息让对方认为销售人员就是保险公司的工作人员,保险公司也未就保险代理人的委托性质进行宣传,故对绝大多数普通市民而言,保险代理人与保险公司之间的关系并不清晰,保险公司不得以其与代理人之间的内部约定对抗善意第三人。消费者基于保险公司与保险代理人之间存在的特殊关系,有理由相信保险代理人享有组织旅游的代理权而与之进行民事法律行为,代理行为的后果应由保险公司承受。
