个案急呈:余某是一家金融公司的员工。未到公司前,他在部队服役期间,因公负伤致残,已取得革命伤残军人证。余某到该金融公司后,与公司签订了无固定期限的劳动合同。2008年12月13日,余某旧伤复发。2009年5月12日,他得知公司的一名员工在工作中发生工伤后,被鉴定为伤残六级,得到了一次性伤残补助费。于是,余某找到公司也要求享受此待遇。公司不同意,双方为此发生争议。
