由于历史原因,非洲国家的法律制度不可避免地受到了前宗主国法律的影响。但是由于独特的政治、经济和文化等方面的现实原因,非洲国家在刑事政策上并没有对西方采取亦步亦趋的态度,而是一反西方现代刑事思潮的主流,更多地主张重典治世。尽管近年来非洲国家的刑事立法和司法中也不乏一些轻刑化的缓和考量,但毕竟没有成为刑事政策的主流。由于上述现实原因在短期内不可能有重大变化,所以非洲国家仍将在较长时期内奉行这种较为严厉的刑事政策。
Due to historical reasons, the legal system of African countries is inevitably affected by the laws of the former suzerain countries. However, due to the unique political, economic and cultural realities, the African countries have not adopted the same attitude toward the West in their criminal policies. Instead, they have opposed the mainstream trend of the modern criminal trend of thought in the West and advocated more the rule of common law. Although the criminal legislation and the judiciary in African countries in recent years are not without some derogatory considerations regarding light punishment, they have not, after all, become the mainstream of criminal policies. Because of the above factual reasons, it is impossible to make major changes in the near future, African countries will still pursue such a severe criminal policy for a relatively long period of time.
