不动产登记制度是物权变动规则中的重要组成部分,也是物权法的重要内容,是对土地、地上建筑物的所有权及他项权利按照法定程序在专门簿册上进行记载确认的制度。《物权法》的出台是我国的不动产登记制度的一大进步,但是随着《物权法》的实行,不动产登记制度在理论和实践方面仍有一些不足之处。本文从《物权法》出发,结合我国国情,通过对不动产登记的效力、不动产登记机关、不动产登记错误赔偿制度等方面进行探讨,进而提出完善我国不动产登记制度的一些建议。
Real estate registration system is an important part of the rules of real rights changes, but also an important part of the Property Law is the ownership of land, buildings and other rights in accordance with the statutory procedures in the book record confirmation. The introduction of “Property Law” is a great progress in the real estate registration system in our country. However, with the implementation of the “Property Law”, the real estate registration system still has some shortcomings in theory and practice. In this paper, starting from the “Property Law”, combined with China’s national conditions, through the real estate registration effectiveness, real estate registration authority, real estate registration error compensation system to explore, and then put forward some suggestions to improve China’s real estate registration system.
