本文以叙利亚化武事件联合国调查团的事实结论为线索,分为结论前和结论后两个阶段。本文认为,不同的时间节段和不同的事实结论,会引领我们做出不同的政策和法律的思考。在第一阶段,我们既坚决反对使用化武,但又反对贸然的动武。在第二阶段,我们赞成俄罗斯提出的国际监督方案,对于是否提交到估计刑事法院问题,将根据《估计刑事法院规约》的规定,审慎处理。 This article takes the factual conclusions of the UN investigation team in Syria as a precursor to the conclusion of the conclusion and the two post-conclusion phases. This article argues that different time segments and different factual conclusions lead us to think differently about policies and laws. In the first phase, we are both resolutely opposed to the use of chemical weapons, but we oppose the use of force. In the second phase, we are in favor of Russia’s proposal for an international monitoring program and we will deal with it prudently in the light of the provisions of the Statute on the Estimation of Criminal Courts.
