随着世界经济的不断发展,如何加强知识产权保护早已成为世界各国政府间磋商经济合作的重点话题之一。ACTA作为最新提出的知识产权保护执法机制,它旨在协议各国共同打击产品假冒和盗版侵权行为。较之TRIPS,ACTA不仅仅进一步细化民事执法、边境保护措施、刑事执法等相关方面的规定,还在此基础上新增了数字环境知识产权执法一节内容。本文拟通过对ACTA文本与TRIPS协议间的比对研究,找出ACTA强化知识产权执法之处,探讨ACTA可能会给国际知识产权保护带来的影响以及对我国的相关启示。
With the continuous development of the world economy, how to strengthen the protection of intellectual property rights has long been one of the key topics for the negotiation and economic cooperation between the governments of various countries in the world. ACTA, the latest IPR protection law enforcement mechanism, aims to agree that all countries jointly combat counterfeiting and piracy of products. Compared with TRIPS, ACTA not only further elaborates the relevant provisions of civil law enforcement, border protection measures and criminal law enforcement, but also adds a section on the enforcement of IPR in digital environment. In this paper, we try to find out where ACTA should strengthen the enforcement of intellectual property by comparing the ACTA text with the TRIPS agreement, and discuss the impact that ACTA may have on the international protection of intellectual property and its implications for China.
