依法独立行使审判权是衡量社会法治化建设的一个重要标尺,是现代社会绝大多数法治国家确立的一项基本法律准则。当前我国法治化建设处于初始阶段,整体法治化的大环境还需完善。司法独立是现代司法改革的重要关键,是实现司法公正的必要条件,而要实现司法独立,其本质在于实现和确保法院及法官依法独立行使其审判权。
The independent exercise of judicial power according to law is an important measure of the construction of a society under the rule of law and is a basic legal guideline established by the vast majority of countries ruled by law in modern times. At present, the construction of China’s rule of law is in its infancy, and the overall legal environment needs to be improved. The independence of the judiciary is an important key to the reform of the modern judicial system and a necessary condition for judicial justice. To achieve judicial independence, the essence is to realize and ensure that courts and judges independently exercise their judicial power according to law.
