虽然“可持续”思想经过近30年的发展已被联合国众多决议确立为各国经济-人口-资源-环境发展的指导思想,但正式将它写入国家法律,把它明确为国家基本法律原则的,可以说新西兰是第一个。《资源管理法》是新西兰在“可持续资源管理”的原则指导下制定的,是涵盖土地、大气、水、海岸、地热和污染的综合性的自然资源和环境管理的框架法。本文从考察新西兰资源环境状况出发,对《资源管理法》的政治基础、哲理基础、主要内容和实施等情况作一综述和短评。
Although nearly 30 years of “sustainable” thinking has been established by many UN resolutions as the guiding ideology for the economic, population, resources and environment development of all countries, it has been officially written into national laws and clearly defined as the basic legal principles of the country It can be said that New Zealand is the first one. The Resource Management Act, which New Zealand has developed under the principle of “sustainable resource management”, is a framework law covering a comprehensive natural resource and environmental management of land, air, water, coasts, geothermal and pollution. Based on the study of the resource and environment in New Zealand, this article reviews and summarizes the political basis, philosophical foundation, main contents and implementation of the Resource Management Law.
