本文所讨论的问题是中国的地方人大如何才能促进法治的发展。对于“法制”和“法治”这两个词语的理解在某种程度上应当大有不同。在那些法治不断增长的地方,社会中出现了更多的富有组织化的利益集团,它们能够运用法律武器来追求自身的利益。中国的立法机关与自由民主政体的立法机关相比,就立法者组织结构的聚合程度以及利益表达的组织化程度而言,两者在权力职责和投票行为上并没有什么重大不同。立法机关的改革能够改善其政党治理的水平,并且能够提高自身的立法效率。当立法机关被当作整合不同社会利益的手段的时候,它就可以当之无愧地称为法治的助推器了。
The issue discussed in this article is how China’s local people’s congresses can promote the development of the rule of law. To a certain extent, the understanding of the two terms “legal system” and “rule of law” should be quite different. In those places where the rule of law continues to grow, more and more organized interest groups have emerged in society, and they can use legal weapons to pursue their own interests. Compared with the legislature of liberal democracies, China’s legislature does not make any significant difference in terms of power responsibility and voting behavior in terms of the extent to which the legislator’s organizational structure is aggregated and the degree of organization of interests expressed. The reform of the legislature can improve the level of its party governance and improve its own legislative efficiency. When the legislature is treated as a means of integrating the interests of different societies, it can deservedly be called the booster of the rule of law.
