一、违法建筑的定义广义的违法建筑即违反宪法、法律、行政法规和地方性法规、自治条例和单行条例的建筑物和构筑物。狭义的违法建筑即为违反法律规定的建筑物和构筑物。但国务院颁布的《国有土地上房屋征收与补偿条例》与《不动产登记暂行条例》中分别对违法建筑的征收和不动产的登记做出了规制,即行政法规也应该包括在违法建筑的“法”的范围内。所以,笔者认为违法建筑是违反法律、行政法规的建筑物和构筑物。二、违法建筑的权属
