为保障食品安全和人类健康,保护生态环境,需要加强对农药的管理。我国农药管理立法存在法律位阶低、管理机构职责利益冲突、管理制度不健全等缺陷,导致农药污染现状严峻。借鉴农药管理立法的域外经验,我国应提高农药管理立法的位阶,管理机构改由环保部门负责,健全细化农药管理诸环节的制度,明确减少农药使用的环境经济激励机制,严格各主体的法律责任,加大信息公开,以实现对农药的安全性管理。
In order to ensure food safety and human health and protect the ecological environment, we need to strengthen the management of pesticides. Pesticide management legislation in our country has such problems as low legal level, conflicting interests and responsibilities of management agencies, and imperfect management system, which leads to the serious situation of pesticide pollution. Reference to the extraterritorial experience of pesticide management legislation, our country should raise the rank of pesticide management legislation, the regulatory agencies should be replaced by the environmental protection department, and refine the system of pesticide management links, clearly reduce the use of pesticides and environmental economic incentives, and strictly the main Legal responsibility, increase information disclosure, in order to achieve the safety of pesticide management.
