温家宝总理在十届全国人大二次会议上所作的政府工作报告中专门指出 ,要进一步完善公众参与、专家论证和政府决策相结合的决策机制 ,保证决策的科学性和正确性 ,所有重大决策都要在深入调查研究、广泛听取意见、进行充分论证的基础上 ,由集体讨论决定。由此可见 ,公众参与将成为我国行政改革中具有重大意义的举措。公众参与可以增强行政过程的正当性 ,提高行政决策的质量及理性化程度 ,调动公众的积极性和主动性 ,但是目前我国法学界对公众参与机制的诸多问题仍然缺乏深入研究。有鉴于此 ,本刊特邀国内部分专家、学者就“行政过程中的公众参与”问题展开探讨 ,以期对丰富我国的行政法学理论以及进一步完善我国的公众参与机制有所帮助
In his government work report made at the Second Session of the Tenth National People’s Congress, Premier Wen Jiabao pointed out that we must further improve the decision-making mechanism of combining public participation, expert argumentation and government decision-making so as to ensure the scientific and correct decision-making. All major policy decisions It is up to the collective discussion to decide on the basis of conducting in-depth investigations and studies, extensively listening to opinions, and fully arguing. Thus it can be seen that public participation will become a measure of great significance in the administrative reform in our country. Public participation can enhance the legitimacy of the administrative process, enhance the quality and rationality of administrative decision-making, and mobilize the enthusiasm and initiative of the public. At present, however, there is still a lack of in-depth study on many problems of the public participation mechanism in China’s jurisprudence. In view of this, we have invited some domestic experts and scholars to discuss the issue of “public participation in the administrative process”, with a view to enrich our theory of administrative law and further improve our public participation mechanism.
