公安行政自由裁量权为公安行政执法活动所必须,但是过度的自由空间又会造成公民权益的侵害,因而,需要对公安行政自由裁量权进行规制。从内部自律出发,从公安机关内部执法管理角度出发,为有效规制自由裁量权,进而促进公安机关执法规范化建设提出几点构想。 Public security administrative discretion is necessary for public security administrative law enforcement activities, but excessive free space will result in encroachment of citizens’ rights and interests. Therefore, the public security administrative discretion needs to be regulated. Starting from the internal self-regulation, starting from the perspective of law enforcement management within the public security organs, several suggestions are put forward for effectively regulating the discretion and further promoting the construction of law enforcement by public security organs.
