1994年7月5日,一个让亿万劳动者振奋的日子。庄严肃穆的人民大会堂会议厅,出席八届全国人大常委第八次会议的125名委员庄重地按下了表决器。人们翘盼多年的以保护劳动者合法权益为宗旨的《中华人民共和国劳动法》诞生了。同日,国家主席江泽民签署主席令向全国、向世界公布了这部被称为“第二宪法”的基本法,并于1995年1月1日起实施。亿万劳动者奔走相告,我们终于有了一顶“安全帽”。●裁判,何时成为法官根据我国劳动部门的调查,近几年来发生的劳动争议案件,多表现为企业侵犯劳动者的合法权益,归纳起来大致有5个方面;一是超时加班现象普遍,损害工人身心健康。这种情况在沿海地区“三来一补”企业比较严重。例如深圳蛇口工业区内200多家此类企业,工人每天工作10至12个小时的占90%,有的一个月还轮不到一个休息日,加班是强制性的,如有不服者,轻则扣工资重则解雇。二是企业拖欠工资,引起工人不满。据广东省劳动部门统计,深圳市和惠州市于1992年发生的劳动争议及怠工案,绝大部分是由此引发的。三是工人生活设施简陋,医疗卫生没有保障。许多“三来一补”企业没有职工食堂和集体
