经营者的自由选择权与消费者的自由选择权有着本质的区别。从法理上讲,商家没有权利在社会通行的法律或道德规范之外对其服务对象消费者另设规范,制约其并未违背法律规范或社会公德的消费行为,并以此对其服务对象进行选择。当商家将“保留选择顾客的权利”视为自己的自由权时,它却在事实上侵犯了公民的平等权。平等权是公民的一项基本权利。在即将开始的更为激烈的市场竞争中,国内商家理应形成或培育对所有消费者都予以平等的“公民待遇”的习惯。
There is an essential difference between the free choice of operators and the freedom of choice of consumers.
