在国际经济的发展过程中,客观存在着有其自身独立特征的国际货币关系。这种国际货币关系包括:私人在跨国民商事交易中所产生的债务因货币兑换而引起的国际货币关系、国家对本国货币与外国货币间的兑换进行管理而产生的国际货币关系、国家间的公债务因货币兑换而产生的国际货币关系以及国际社会就货币兑换问题而进行的国际协调与合作关系。它们紧密联系、相互交织而形成错综复杂的国际货币关系,已很难将其纳入现存法律体系中的某一法律部门,必然要在现存的法律体系中形成一个新兴的、相对独立的法律部门予以专门的调整,这个法律部门就是国际货币法。国际货币法并不隶属于国际金融法,它们是相互独立的两个法律部门。
