《聊斋志异》“神判”公案小说将离奇荒诞的鬼神故事作为叙事文本模式,用以鬼神为戏的叙事态度,迎合世俗大众猎奇寻异的审美娱乐心态,表现出中国古代通俗文学的审美惯性。同时,《聊斋志异》具有广泛传播效力,加上“聊斋神判”的“超自然”威慑力及其“义理决狱”的超现实公正性,因而对中国文学史和法制史的演进都产生了重要影响。该文试图从“神判”的叙事模式、司法特征、伦理内涵、法律想象等几个方面出发,浅析《聊斋志异》一书的“神判”文化,从而揭示出中国公案小说的司法情结和文化基因。
