主持人:某劳动者原在甲煤矿工作,离职时未诊断出职业病。后其又去乙煤矿工作,并被诊断为煤工尘肺,但该职业病诊断证明书标识用人单位仍是甲煤矿。社会保险行政部门认为该劳动者与甲煤矿是否存在劳动关系有疑义,拒绝进行工伤认定,要求该劳动者先确认与原单位之间存在劳动关系。
Moderator: A laborer was originally a coal mine, leaving his job without diagnosis of occupational diseases. After it went to B coal mine work, and was diagnosed as coal workers pneumoconiosis, but the occupational disease diagnosis certificate identifies the employer is still a coal mine. The administrative department for social insurance considered that there was any doubt as to whether the laborer had any labor relationship with that of the coal mine and refused to make an identification of the work-related injury and required the laborer to first confirm the existence of labor relations with the original unit.
