强制隔离戒毒制度的构建是我省目前戒毒制度的建设重点,目前,我省强制隔离戒毒制度构建中存在的主要困境是强制隔离执行场所的效果。由于历史原因形成强制隔离戒毒场所面临选择公安强制戒毒场所和司法劳教场所的现状,二选一、二合一或者选择维持现状都是两难选择。我们的研究结论是:云南省强制隔离戒毒执行权应由公安机关统一适用更具合理性。这种安排既符合现代行政法制原则,更适应我省禁吸戒毒现实斗争需要,也为强制隔离戒毒资源整合的全国性难题提供比较研究样本。 At present, the main dilemma existing in the construction of compulsory isolation and drug treatment system in our province is the effect of enforcing the isolation of execution places. Due to historical reasons, compulsory isolation of drug treatment centers is faced with the current situation of choosing public places for compulsory drug rehabilitation and judicial re-education through labor camps. Choosing one or two in one or choosing to maintain the status quo are both dilemmas. Our study concluded that enforcing the right to enforce isolation and drug enforcement in Yunnan Province should be more rationally applied by the public security organs. This arrangement conforms to the principle of modern administrative law and is more suitable for the practical struggle against drug abuse and drug abuse in our province. It also provides a sample of comparative studies on the national challenges of compulsory isolation of drug resource integration.
