2010年,中国—东盟自由贸易区全面建成,中国与东盟之间的贸易飞速发展,而在东盟十国中,尤以新加坡、马来西亚、泰国、越南、文莱、印尼、菲律宾这七国发展最为迅速,与中国的贸易关系也更为密切,于是“泛北部湾经济合作区”这一概念应运而生。随着泛北部湾经济合作区的经济贸易合作增多,各国之间的知识产权争端也日益增多,因此对泛北各国的知识产权法律进行协调和统一的需求就越迫切。本文通过分析泛北部湾经济合作区知识产权法律协调的可能性和必要性,旨在探讨构建法律协调机制的方向和途径,促进泛北部湾经济合作区的经济发展,开创一个新的区域合作格局。
In 2010, China-ASEAN Free Trade Area was fully completed and the trade between China and ASEAN developed rapidly. Among the 10 ASEAN countries, Singapore, Malaysia, Thailand, Vietnam, Brunei, Indonesia and the Philippines are the most developed countries Rapidly, trade relations with China are also closer, so the concept of “Pan-Beibu Gulf Economic Cooperation Zone” came into being. As economic and trade cooperation between Pan-Beibu Gulf Economic Cooperation zones has increased and intellectual property disputes among various countries have also been on the rise, the more urgent the need for coordination and unification of the laws governing intellectual property in Pan-Beibu Gulf countries. By analyzing the possibility and necessity of the coordination of intellectual property law in Pan-Beibu Gulf Economic Cooperation Zone, this paper aims at exploring the direction and ways of building legal coordination mechanism, promoting the economic development of Pan-Beibu Gulf Economic Cooperation Zone and opening up a new pattern of regional cooperation .
