产品或服务的经济学属性影响其供给合同的法律适用。强制缔约规则作为合同法特殊规则之一,适用的消费者合同主要是生活资源型及基本服务型准公共产品合同,也适用于垄断经营的私人产品合同,不宜扩张适用于非垄断经营的私人产品合同。当消费者符合准公共产品的排他性条件,或出现超出经营者供给能力的情形,经营者强制缔约义务得以豁免。该义务不得豁免于经营者不当设置的缔约条件。强制缔约规则的适用及豁免随产品或服务的经济学属性、经营者营销策略和市场地位的变化而演变。
The economic attributes of a product or service affect the law applicable to its supply contract. As one of the special rules of the contract law, the applicable contract of contract mainly includes life resource-based and basic service-oriented quasi-public-product contracts as well as monopoly private-product contracts. It is not appropriate to expand private products applicable to non-monopoly operations contract. When the consumer meets the exclusive conditions of quasi-public goods, or appear beyond the capacity of the operator’s supply, the operator to make a treaty obligations to be exempted. This obligation shall not be exempt from the conditions of the contract improperly set by the operator. The application and exemption of the mandatory contract rules evolve as the economics attributes of the product or service, the marketing strategy of the operator and the market position change.
