我国中央政府在改革开放中向地方政府的分权,赋予了地方政府在经济社会事务领域广阔的自主权。这既有力地促进了中国三十余年来的经济增长,也催生了威胁全国统一市场的地区垄断现象。现阶段,我国主要通过行政内部控制和司法控制治理地区垄断。行政内部控制由两条语词和逻辑皆不相同的路径组合而成,其间的摩擦与耗散降低了行政内部控制的总体效果。而随着分权对中国政治结构的影响和中央地方关系的初步法治化,通过行政诉讼实现的司法控制正在愈发重要。但是,我国的司法系统并未摆脱对中央政府公共政策的过度支持与回应。这注定了在司法裁判中,统一市场的话语必然压倒地方自治的话语,对地区垄断的治理可能转化为对地方自治合理需求的侵害。
The decentralization of the Central Government of our country to the local government during the reform and opening up has given the local government a broad autonomy in the economic and social affairs. This not only has vigorously promoted the economic growth in China for more than 30 years, but also has given rise to a monopoly in the region that threatens the unified national market. At this stage, our country mainly manages regional monopolies through internal control and judicial control. The internal control of the administrative system is composed of two paths with different words and logic. The friction and dissipation between them reduce the overall effect of the internal control of the administrative system. With the influence of decentralization on China’s political structure and the initial legalization of the central-local relations, judicial control through administrative litigation is becoming more and more important. However, our judicial system has not escaped the over-support and response to the central government’s public policies. This is doomed in judicial decisions, the words of a unified market will inevitably overwhelm the words of local autonomy, the governance of regional monopolies may translate into violations of the legitimate needs of local autonomy.
