【案例】原告于2008年购买了北屯一住宅楼,但一直未入住。2010年5月,被告未经原告许可在原告房屋顶部安装其经营的同福旅馆的广告牌。因被告设立该广告牌时,在原告的房屋顶部进行了钻洞、打眼等活动,将原告房屋墙体损坏。原告多次找被告协商要求拆除广告牌,但被告均拒绝拆除。原告请求依法判令被告立即拆除广告牌,并将房屋顶部恢复原状,消除潜在隐患。
[Case] The plaintiff purchased a residential building in Beitun in 2008, but never stayed. In May 2010, the defendant installed billboards on the top floor of plaintiff’s premises with Tongfu Hotel, which he operated without the plaintiff’s permission. When the defendant set up the billboard, drilling, drilling and other activities were carried out on the top of the plaintiff’s house to damage the plaintiff’s house wall. The plaintiff repeatedly sought the defendant’s consultation to dismantle the billboard, but the defendants refused to dismantle. The plaintiff requested that the defendant be ordered to dismantle the billboard immediately and to restore the top of the house to the status quo ante to eliminate potential risks.
