作者通过对女权主义的细致分析表明经验性研究本身并不能自动地转变为法律政策。相反,当作为媒介的法学理论所提供的理论视角本身被未经审查的假定所遮蔽时,理论则可能导致决策者无视社会变化的证据或不平等持续存在的证据。因此,一个全新的法律现实主义框架将需要质疑理论作用本身,让学者了解在人们知道什么与法律如何运作之间发生的转变过程。女权主义理论为这种适中的理论提供了一种重要模式。
Through careful analysis of feminism, the author shows that empirical research itself can not be automatically translated into legal policy. On the contrary, when the theoretical perspective provided by the jurisprudence as a medium is itself obscured by uncensored assumptions, the theory may lead policymakers to disregard the evidence of social change or the persistence of evidence of inequality. Therefore, a completely new legal realism framework will need to question the theoretical role itself and inform scholars about the transition that takes place between what people know and how the law works. Feminist theory provides an important model for this modest theory.
