2014年11月1日修改的《行政诉讼法》规定了规范性文件附带审查制度,其重要性毋庸置疑。2015年4月22日公布的《最高人民法院关于适用<中华人民共和国行政诉讼法>若干问题的解释》也用两个条款对其作出解释,解决了附带审查请求时限、裁判理由中阐明规范性文件的违法性以及处理建议的抄送机关等三个问题。规范性文件附带审查制度的设计应从请求条件、审查范围、审查标准,以及审查后的处理出发,完成科学的、有效运转的制度构建。
