中国入世之后,经济特区特殊优惠政策是否有违WTO国民待遇原则,特区是否有继续存在的必要,有人对此持否定态度。毫无疑问,中国的入世确实给经济特区原有立法及优惠政策带来了一定的冲击。然而,WTO非歧视性和国民待遇原则设定了诸多有限性及例外性的条款,WTO并不排斥特殊经济区的存在,也一定程度上认可为区域内的企业提供政策支持。因此,中国入世并不影响特区存在及发展,只是对经济特区的立法提出了更高层次的要求。基于此,笔者从WTO的原则规定及与现有经济特区立法冲突为角度,探讨特区立法在这一新的历史时期的发展思路。
After China’s accession to the WTO, some people hold a negative attitude toward this whether SAR special preferential policies violate the principle of WTO national treatment and whether there is any need for the continued existence of the SAR. Undoubtedly, China’s accession to the WTO does indeed have a certain impact on the original legislation and preferential policies of the SEZs. However, WTO principles of non-discrimination and national treatment set a number of limited and exceptional provisions. The WTO does not exclude the existence of special economic zones. It also acknowledges to some extent that it provides policy support to enterprises in the region. Therefore, China’s WTO accession does not affect the existence and development of the SEZ, but merely sets higher-level demands on the legislation of the SEZs. Based on this, the author discusses the development ideas of the SAR legislation in this new historical period from the perspective of the WTO rules and the conflict with the legislation of the existing special economic zones.
