本文首先简要描述《北美自由贸易协定》(NAFTA)自由贸易委员会(FTC)对公平与公正待遇作出解释的背景及内容;随后,文章考察NAFTA下以美国为被申请人的案件,从限定解释习惯国际法、提高认定门槛、重新解释公平与公正等三个方面,分析美国对公平与公正待遇的态度,即逐渐缩小公平与公正待遇的内涵及其适用范围,提高认定违反公平与公正待遇的门槛;最后,结合美国双边投资协定(BIT)范本规定的变化,探讨美国投资争端实践对BIT范本修订的影响。
This article begins with a brief description of the background and content of the NAFTA Free Trade Commission’s interpretation of fair and equitable treatment. Subsequently, the article examines the case of the United States as the respondent under the NAFTA, International law, raising the threshold of recognition, reinterpreting fairness and fairness, and analyzing the attitude of the United States towards fairness and fairness, that is, gradually narrowing the connotation and scope of fair and equitable treatment and raising the threshold for violating the fair and equitable treatment. Finally, the paper discusses the impact of the practice of US investment disputes on the revision of BITs in light of the changes in the provisions of the U.S. BIT model.
