物权法确立了不动产物权统一登记制度,并在第21条规定了不动产登记当事人和登记机构在登记错误给他人造成损害时的赔偿责任。但由于该条规定过于原则和粗放,对错误登记损害赔偿责任的性质、归责原则以及救济渠道等没有明确规定,导致司法实践中对该条的适用存在争论。本文将对上述问题进行探讨、分析,以期对司法实践有所裨益。
Real Right Law established a unified registration system of real property rights, and Article 21 of the real estate registration of the parties and registration agencies in the registration of errors caused damage to others liability. However, since this article provides too much principle and extensiveness, there is no clear stipulation on the nature of liability for wrong registration damage, the principle of imputation and the channel of relief, which leads to the controversy in the judicial practice on the application of the article. This article will explore and analyze the above issues, with a view to the judicial practice of some benefit.
