HR来信:我公司招了一批工人,入职时,每个人向公司提交了一份申请书,其中明确提出,要求公司不给他们缴纳社保,而是按月向他们多支付一点工资。在提交申请时,这些员工还向公司提出,如果公司给他们交社保,扣了他们的工资,他们就集体辞职。由于可以压缩社保成本,又有他们本人的申请,所以我们答应了他们的请求。为了稳妥,我们跟这些员工都签了协议书,明确约定是他们申请不缴的,他们不能再去投诉或者仲裁。可是,我们总感觉这个做法有些问题,想问一下,我们这么做合法吗?
