德国犯罪论经过“古典犯罪论体系”、“新古典派及目的主义的犯罪论体系”,逐步实现从客观到主观,从形式到实质的转变。在这一漫长发展路程中,“构成要件符合性——违法性——有责性”的递进式犯罪论体系不断成熟与完善,也受到挑战。其中贝林格、迈耶、梅茨格尔、威尔泽尔、阿道夫.默克尔等学者在两个关键问题上进行了持久的硝烟弥漫的争论。本文笔者试从德国犯罪论的变迁来分析其发展趋势,并探讨变迁的深层原因。
The German theory of crime goes through the system of “classical criminal theory” and “neoclassical and purposive criminal theory” and gradually realizes the transformation from objective to subjective and from formal to substantive. In this long course of development, the progressive crime theory system of “conformity of elements - illegality - being responsible” has been constantly matured and perfected and also challenged. Among them, Behringer, Meier, Metzger, Weilzer, Adolf Merkel and other scholars conducted a protracted and perplexed debate on two key issues. In this paper, I try to analyze the development trend of the crime theory in Germany and explore the underlying causes of the change.
