十八届四中全会审议通过的《中共中央关于全面推进依法治国若干重大问题的决定》中明确提出“深入推进依法行政,加快建设法治政府”的改革目标。近年来,我国各地政府法律顾问制度建设已经有所成效,但总体来看,仍然存在着一些问题:相关保障不足,法律顾问制度缺乏足够的支撑;政府法律顾问(团)人员组成单一;政府法律顾问成员评选机制有漏洞。这些问题严重阻碍了法治政府建设的进一步发展,为此我们应该建立科学规范、行之有效的政府法律顾问管理体制;加强对政府法律顾问工作的保障力度(经费和人才);积极学习其他地区先进的管理经验,努力探索适合本地区的法律顾问制度。我们需要准确定位政府在法治建设中的作用,促使制度更加健全,逐步完善政府法律顾问制度。

These problems have seriously hindered the further development of the construction of a government ruled by law. To this end, we should establish a scientific, standardized and effective management system for government legal advisers; strengthen the protection of government legal advisers (funds and talents); actively study other advanced areas Management experience, and strive to explore the legal adviser system for the region. We need to accurately define the role of the government in the rule of law, promote a more sound system and gradually improve the system of government legal advisers.
