对于美国最高法院应当采取何种方式来解释宪法,从而使宪法解释本身符合民主的要求?我国法学界对这一问题采取的是一种普遍化的立场。这种分析本身就在一定程度上脱离了美国宪法解释的语境。“语境论”的分析进路有利于我们洞见到宪法的各种解释进路与其所主张的民主之间的真实关系,从而摆脱简单的“非此即彼”的困境。在“斯科特案”中,时代背景、法官秉性、政治因素等诸多要素对宪法采取的原旨主义解释进路实现民主的诉求具有重要影响。
How should the Supreme Court of the United States interpret the Constitution so that constitutional interpretation itself meets the requirements of democracy? The jurisprudence of our country adopts a universal position on this issue. This analysis itself is somewhat out of the context of the American constitutional interpretation. The analysis approach of “contextualism” helps us to find out the true relationship between various constitutional interpretations and the democracy that it advocates, and thus to get rid of the simple predicament of “not or not”. In the case of Scott, many elements such as the background of the times, the nature of judges and political factors have an important influence on the pursuit of democracy by the fundamentalist interpretation of the Constitution.
