ADR是指诉讼外或非诉讼解决争议的各种方法的统称,而ODR是一种能独立于当事人的物理场所、大部分或主要过程利用因特网技术进行的争议解决机制。ODR不能仅仅看成是ADR的在线形式,两者既有联系又有区别。两者的联系是ODR从ADR运动中起源,两者追求的理念基本相似,发挥的功能与作用相同,两者互相包容,互相补充。两者的区别是产生的时间及背景不同、解决争议的地点不同、在线技术所发挥的作用不同以及包含的范围不同。但不管怎样,ODR与ADR都是整个争议解决机制的有机组成部分。
ADRs refer to the general term for various methods of dispute resolution either in litigation or non-litigation, and ODR is a dispute resolution mechanism that uses Internet technology for most or all of its processes independent of the client’s physical location.
