我国少年司法制度自诞生以来,在治理少年犯罪和保护少年成长上发挥了重大积极的作用,但仍存在很多问题,尚待完善。本文旨在理论和实践两个层面对我国少年司法制度进行反思,并提出包括树立正确的少年司法理念——保护、教育、复归,加强少年立法,创设少年法院,确立全面调查、合适成年人参与、指定辩护、审判不公开、刑事污点取消、暂缓判刑和社区矫正等制度等设想。 Since its birth, the juvenile justice system in our country has played an important and active role in the management of juvenile delinquency and the protection of juvenile growth. However, many problems still remain to be perfected. This article aims to reflect on China’s juvenile justice system both theoretically and practically.
