在产品责任中,生产者可援引发展风险抗辩对因当时科学技术水平所限而无法发现的产品缺陷免责,保护了经营者的生产积极性并促进科技革新,而该法条规定的不明确却导致了实践中适用的困难。同时2009年《侵权责任法》规定了后续观察义务,要求生产者对产品投入流通后产生的缺陷所造成的损害承担侵权责任。文章将以产品发展缺陷免责适用上的问题以及是否与后续观察义务之间存在矛盾为焦点展开阐述,并提出相应法律建议。
