添附是指通过结合使得归属于不同所有人的物重新形成不可分离的物或具有新性质的物,包括加工,混合和附合,添附制度是各国物权法中公认的一种确权手段,也是一个重要的物权变动方式。添附制度作为一项独立的物权制度,其独立价值不能为侵权请求权、物权请求权,不当得利返还请求权制度取而代之。独立健全的添附制度的确立在我国《物权法》的制订过程中有着不可忽视的重要地位。
