案件以及侦查中的所谓“不可知信息”,是指在案件中客观存在的,由于案件的当事人(作案人、报案人、侦查员、证人及其他与案件有关人员)在案件发生和侦破过程中直接参与、接触或者在场等,掌握全部或部分外人不可能知道的案件信息(特别是犯罪现场信息)。在这些当事人中,由于作案人实施了犯罪全过程,因而掌握的“不可知信息”最多、最充分。这些信息可以转换为揭露、证实和打击犯罪的证据,这种证据就是我们所说的“不可知信息证据”。反之,其他非当事人通过道听途说等途径或由于案件保密等原因使其直接接触进而掌握了部分案件信息(如露天现场尸体),这些表面的、局
