《侵权责任法》视野下雇主追偿权的合理规制

从我国当前的司法实践及用工状况来看,肯定雇主追偿权有一定的必要性与合理性。长期以来,学术界和立法部门对雇主追偿权制度缺乏足够的重视,只有司法解释对此进行了有限规范。限制雇主追偿权是审判部门自觉的价值取向。在修订《侵权责任法》时,应更多的考虑照顾弱者的价值取向,今后对雇主追偿比例进行合理规制,把雇主追偿权限定为雇员存在故意或者重大过失时的适当追偿。 Judging from the current judicial practices and labor conditions in our country, it is necessary and affirmative to affirm the employer’s right of recovery. For a long time, academics and legislatures lack sufficient attention to the employer’s system of recourse, which is limited by judicial interpretation. Restricting the employer’s right to recover is the conscious value orientation of the trial department. When amending the Tort Liability Law, we should give more consideration to the value orientation of taking care of the weak and, in the future, rationally regulate the proportion of employers’ compensation and limit recourse of employers to the proper recovery of an employee in the event of intentional or gross negligence.
