金融全球化使防范金融风险特别是系统性风险成为一个国际化的课题。国际金融监管合作和法律协调被提上议事日程。现有的国际金融监管法律制度是以巴塞尔体制为范本建立起来的 ,其显著特点就是非正式性 ,各监管合作委员会所发布的法律文件都不具有“应然”的国际法效力。这种非正式性在国际监管领域具有很强的生命力和适应性。但随着系统性金融危机的发生 ,这种非正式性又成为现有国际金融监管法律制度主要局限之所在。
Financial globalization has made it an international issue to prevent financial risks, especially systemic risks. International financial regulatory cooperation and legal coordination were put on the agenda. The existing legal system of international financial supervision was established based on the Basel system. The notable feature of the legal system is informality. All legal documents issued by various regulatory cooperation committees do not have “due” international legal validity. This informality has strong vitality and adaptability in the field of international regulation. However, with the occurrence of a systemic financial crisis, this informality has become the main limitation of the existing legal system of international financial supervision.
