社会保险争议民事可诉性是否全面确立事关劳动者社会保险权益的实现。最高人民法院在相关司法解释中对社会保险争议的民事可诉性作了限制,各地法院司法实践的处理标准极不统一。《社会保险法》及相关部门规章为全面确立社会保险争议民事可诉性提供法律依据。用人单位与劳动者之间各种类型的社会保险争议均应纳入民事可诉性范围,其法理依据在于民事司法救济机制符合社会保险争议的基本特性,符合社会保险争议为劳动合同争议的本质要求,并与社会保险争议的特殊性不发生矛盾;同时,行政救济机制并不能完全取代民事司法救济。在社会保险争议民事可诉性的建构上,应对最高人民法院的相关司法解释作出更为恰当的解读,以缓解我国相关法律制度的冲突;社会保险争议诉讼过程中社会保险经办机构可以作为第三人参加诉讼,使民事司法程序更加正当;侵害劳动者社会保险权益的,用人单位可承担民事侵权责任,有利于全面保护劳动者的社会保险权益。

The Supreme People’s Court has restricted the civil suitability of social insurance disputes in relevant judicial interpretations, and the handling standards of judicial practice in various local courts are extremely uneven. “Social Insurance Law” and the relevant departmental rules and regulations provide the legal basis for the full establishment of civil suitability for social insurance disputes. All types of social insurance disputes between employers and workers should be included in the scope of civil suitability. Its legal basis lies in that the civil judicial remedy system conforms to the basic characteristics of social insurance disputes and meets the essential requirements of social insurance disputes for labor contract disputes , And does not contradict with the particularity of the social insurance dispute; at the same time, the administrative relief mechanism can not completely replace the civil judicial relief. In the construction of the civil suitability of social insurance disputes, the judicial interpretations of the Supreme People’s Court should be more properly interpreted to alleviate the conflicts of the relevant legal systems in China. In the process of social insurance dispute litigation, the social insurance agency may act as the Three people participate in the litigation to make the civil justice process more justified. Violating the rights and interests of laborers ’social insurance, the employer can assume the responsibility of civil tort, which is conducive to the overall protection of workers’ social insurance rights and interests.
