中国法制史有着一定的文学和艺术因素,历史文献与文艺文献联系密切。中国法制史教学通过讨论历史上的法律制度与法律思想,分析法律及其价值问题。在教育产业化的背景下,如何将这种“无用之学”生动、形象地展现给低年级学生,关系到学生的法学学习兴趣,也关系到学生人文素养的提升。用文学的表述阐释法律,用艺术的表达讲述法律,能够拉近法制与生活的距离,将在一定程度上加深学生对法律问题的理解,进而提升教学质量、提高课堂效果。同时,中国法制史教学中也应当在文学表述和艺术表达时,注重素材的关联性、必要性,适当、合理地通过辅助手段剖析法律制度,引导学生关注法律及其价值问题。
The legal history of China has certain literary and artistic factors, and the historical documents are closely linked with literary and art documents.
