许可设定作为行政审批制度改革的关键一环,对整个行政审批制度的改革起着重要作用。针对《行政许可法》第12、13条所存在的范围不明确、不具体等方面的诟病,从许可设定的客观依据出发,阐明许可设定的客观对象。其中,遵循许可设定的逻辑起点——公共事务,可以从许可设定的多重变量与多重领域两方面进行分析,以理清许可设定的客观依据。
As a key part of the reform of the administrative examination and approval system, the licensing system plays an important role in the reform of the entire administrative examination and approval system. In view of the unfounded and unspecific scope of Article 12 and Article 13 of the Administrative Permission Law, this article sets out from the objective basis of the permitting the objective object of the permitting setting.
