最新修订的《消费者权益保护法》(以下简称“新《消法》”)规定,耐用商品或装饰、装修等服务,若因瑕疵而纠纷,应由经营者承担举证责任。那么墙砖类制品贴后裂纹、起鼓,如无法技术质检,是否可适用该原则处理呢?若能适用,责任应怎样划?损失该如何赔?本文针对一起此类纠纷,围绕调查、处理全过程,通过原委简介、调查取证、进行调解、案件分析,探讨“举证倒置”原则应用条件和实际效果,并浅谈个人感言。
